LA Product Liability

July 8, 2013 | Product Liability

Product Liability is the law that applies when an injury or damage arises due to a defect in a product. In Louisiana, the statutes that describe product liability claims are known as the Louisiana Products Liability Act. Though anything that causes damage or injury can be justified as a product liability claim, some of the most common claims include a seat belt that failed to lock in an accident, faulty medical devices, and prescription drugs that have caused dangerous health conditions. Product Liability claims usually include situations in which an injury arose from product a defective product that has been recalled. In more recent recalls, hundreds of thousands of cars have been recalled due to faulty airbags. GM, Honda, and Toyota were amongst the major automakers with faulty airbags. In another investigation, the National Highway Traffic Safety Administration has recently received over 10 complaints involving the deployment of Honda Odyssey minivans for no reason. Honda, Jeep, Dodge, Toyota, and General motors have recalled a number of their vehicles due to airbag malfunctions.
